In response to this situation, in July 2022, Affinity Federal Credit Union in the United States filed a lawsuit alleging that Apple's anti-competitive practices were causing more than 4,000 banks and credit unions using Apple Pay to pay at least $1 billion (approximately 157 billion yen) in excessive fees annually.

Then, on September 23, 2026, local time, Judge White approved the motion and allowed the class action lawsuit to continue, as reported by Hagens Berman and Sperling & Slater, the American law firms representing the plaintiffs. This means that American card issuers can now file a class action lawsuit against Apple.
According to Hagens Berman, the class-action lawsuit will target 'all U.S. companies that issue Apple Pay-compatible payment cards and pay Apple fees for transactions made with those cards.'
While Apple charges transaction fees to card issuers, its rival Google's payment platform, Google Pay , does not charge any transaction fees to card issuers. Apple charges card issuers a 0.15% fee for credit card transactions and 0.5 cents (approximately 0.8 yen) for debit card transactions conducted through Apple Pay.

The plaintiffs' lawyers argued that expert testimony could serve as common evidence for the plaintiffs that Apple maintains a monopoly in the 'aftermarket for iOS contactless mobile wallets' and the 'overall mobile wallet market.' Apple, however, requested that this expert testimony be excluded from the evidence, but Judge White rejected Apple's request.
The plaintiffs are seeking refunds from card issuers who were charged Apple Pay fees, as well as an injunction to stop Apple Pay's policies.
