Nintendo sues US government for full refund of Trump tariff payments plus interest



Following the U.S. Supreme Court's ruling that the Trump tariffs were illegal, demands for the return of tariffs have flooded in. However, the International Trade Court ruled the Trump tariffs illegal in May 2025. On February 20, 2026, the U.S. Supreme Court also ruled the tariffs invalid, and more than 1,000 companies, including major retail chain Costco and logistics company FedEx, have filed lawsuits seeking refunds of the tariffs they paid.

According to the news site Aftermath, Nintendo of America (NOA), Nintendo's American subsidiary, has also filed a lawsuit against the US government, demanding a full refund of the tariffs it paid, plus interest.

The defendants are the Department of the Treasury and Treasury Secretary Scott Bessent, the Department of Homeland Security and former Secretary Kristi Noem, the Office of the U.S. Trade Representative and Trade Representative Jamieson Greer, U.S. Customs and Border Protection and Commissioner Rodney Scott, and the Department of Commerce and Commerce Secretary Howard Lutnick.

'This lawsuit concerns unlawful trade actions initiated and implemented by defendants that have resulted in the collection of more than $200 billion in tariffs on imports from nearly every country,' the plaintiffs' lawyers said.

While Customs and Border Protection acknowledged that it has collected $166 billion in tariffs to date, it said it 'cannot comply with the court's order to refund the tariffs at this time.'
